Terms & Conditions

  1. The promoter is Universal Magazines Pty Ltd of Unit 5, 6-8 Byfield St, North Ryde, NSW 2113.
  2. Information on how to enter & prizes form part of these terms and conditions. Entry into the competition is deemed acceptance of these terms and conditions and any entry not complying with these terms and conditions is invalid.
  3. To the extent of any inconsistency between these Terms and Conditions and any other reference to this competition, these Terms and Conditions prevail.

Who can enter:

  1. Entry is open to residents of Australia and New Zealand who are aged 18 years or older and who are not an employee of the Promoter or the Promoter’s related companies, and any agencies associated with this promotion and their immediate families (including spouse, de-facto spouse, parent, child or sibling (whether full, half, step or by adoption).
  2. The Promoter reserves the right to request winners to provide proof of identity in order to claim the prize. Proof of identification, residency and entry considered suitable for verification is at the discretion of the Promoter. In the event that a winner cannot provide suitable proof, the winner will forfeit the prize in whole and no substitute will be offered.

When to enter:

  1. The competition commences at 9am AEST on 05/04/2018 and closes at 11.59pm AEST on 05/09/2018 (‘Promotional Period’). Entries must be received by the Promoter prior to the competition close date and time.
  2. The Promoter accepts no responsibility for any late, lost or misdirected entries.

Acceptable forms of entry are as follows:

  1. By completing an official entry form at the Cosy Project stand at a craft show.
  2. By visiting www.cosyproject.com/blog/ win-a-spot-on-the-sydney-to-new-zealand-craft-fair-at-sea and completing the following entry form fields:
    1. Name
    2. Email
    3. Postcode (Zip Code)
    4. Friends Email(s)
  3. All eligible entries will be automatically entered into the judging.
  4. Entrants are required to take full responsibility for the content of their entry and for ensuring that their entry complies with these terms and conditions. Entries must be the entrant’s original work. The Promoter reserves the right to verify, or to require the entrant to verify, that the entry is the entrant’s original work. If an entry cannot be verified to the Promoter’s satisfaction, the entry will be deemed invalid.
  5. An entrant’s entry must not include any content that contravenes any law, infringes the rights of any person or is potentially insulting, inflammatory, defamatory, obscene, offensive, discriminatory, indecent or otherwise objectionable or inappropriate.
  6. Any entry that is made on behalf of an entrant by a third party will be invalid, unless the entrant requires the assistance of a third party to enter due to a disability.
  7. The Promoter reserves the right to disqualify any entrant who tampers with the entry process, who submits an entry that is not in accordance with these terms and conditions or who has, in the opinion of Promoter, engaged in conduct in entering the Promotion which is fraudulent, misleading, deceptive or generally damaging to the goodwill or reputation of the Promotion and/or Promoter. This includes, but not limited, to entrants and households using multiple email addresses or postal addresses.

Number of entries permitted:

  1. Only one entry per person.

Judging of entries and notification of the winner:

  1. The judging will take place at 10.00am AEST at Universal Magazines, Unit 5, 6-8 Byfield Street, North Ryde, NSW 2113 on 06/09/2018.
  2. This competition is a game of skill, chance plays no part in determining the winner and each valid entry will be individually judged by Universal Magazines based on specific judging criteria.
  3. The promoters decision is final and binding and conclusive and no correspondence will be entered into regarding the competition results or any other decisions the Promoter makes in connection with the promotion.
  4. The winner will be notified in writing by phone or email within 2 working days of the judging.
  5. Prizes will be awarded to person named in the entry. However, in a dispute, will be awarded to the account holder of the entry mechanism used to submit their entry, eg the email address.
  6. Should an entrant’s contact details change during the promotional period, it is the entrant’s responsibility to notify the Promoter. A request to access or modify any information provided in an entry should be directed to the Promoter.
  7. The Promoter is not responsible for any incorrect or inaccurate information, either caused by the entrant or for any technical error, or any combination thereof that may occur in the course of the administration of this competition including any omission, interruption, deletion, defect, theft or destruction or unauthorised access to or alteration of entries.
  8. The Promoter may conduct an unclaimed prize judging at the same time and place as the original judging three weeks after the date of the original judging, to distribute any prize unclaimed by that date, subject to any applicable law. The winning entry judged will win the unclaimed prize/s. The winner/s, if any, will be notified in writing by email within 2 working days after the date of the unclaimed prize judging.

The Prize:

  1. The prize comprises of a shared cabin for 1 person aboard the Celebrity Solstice on the 15 night Auckland cruise to Sydney departing Sydney.
  2. Unless otherwise expressly stated, prize values are based upon the recommended retail prices at the time of first publication of these Terms and Conditions (inclusive of GST). The Promoter accepts no responsibility for change in prize value between now and the ultimate prize redemption date.
  3. The winner must book the prize/cruise by 28th of December 2018 in order to take the prize.
  4. It is a condition of accepting the prize that the winner must comply with all the conditions of use of the prize and the prize supplier’s requirements. It is the responsibility of the winner to confirm such conditions with the prize supplier or other relevant third parties.
  5. All other incidental costs, including transfers to and from the winners home to the airport and/or cruise port, any costs related to passports, visas, taxes and surcharges, travel insurance, additional meals, beverages & optional cruise excursions (all meals onboard the ship are included) and gratuities will be the sole responsibility of the winner.
  6. The prize must be taken as offered and is not refundable, exchangeable, transferable, redeemable for cash or able to be taken in part.
  7. Once the cruise booking is confirmed and ticketed, cancellation charges apply and will be the sole responsibility of the winner.
  8. The winner of the prize must be 18 years or older.
  9. No extension of the validity date of this prize will be permitted. The promoter reserves the right to refuse to allow a winner to take part in any or all aspects of the prize, if the promoter determines, in their absolute discretion, that a winner is not in the mental or physical condition necessary to be able to safely participate in the prize.
  10. In the event that for any reason whatsoever a winner does not take an element of the prize at the time stipulated by the Promoter then that element of the prize will be forfeited by the winner and cash will not be awarded in lieu of that element of the prize.
  11. If any prize or any part of a prize becomes unavailable for reasons beyond the Promoters’ control, the Promoters will endeavour but are not obliged to provide a substitute prize of equivalent or greater value, subject to State Regulation.
  12. Independent financial advice should be sought as tax implications may arise as a result of accepting the prize
  13. INTERNATIONAL TRAVEL: The winner and his or her travel companion are responsible for complying with health and any other government requirements that may apply to the prize. All prize travel will be subject to the carrier’s General Conditions of Carriage. It is the traveller’s personal responsibility to ensure that they have valid travel documentation, including valid passports and visas, which meet the requirements of government authorities at the relevant destinations. Any fines, penalties, payments or expenditures incurred as a result of such documents not meeting the requirements of those authorities will be the sole responsibility of the traveller/s. The Promoter makes no representation as to the safety, conditions or other issues that may exist at any destination. Entrants should obtain travel advice from independent sources, such as the web site of the Australian Department of Foreign Affairs and Trade.

Copyright, Statutory Guarantees, Waivers, Limitations of Liability and General Terms:

  1. In consideration for the Promoter awarding the prize to the winner, the winner hereby assigns to the Promoter all right, title and interest in and to all copyright in any material created pursuant to the winner’s participation in any aspect of the prize (Works). The winner acknowledges that the Promoter is free to use the Works and to exercise its rights in relation thereto and the winner will not be entitled to any fee for such use.
  2. If for any reason any aspect of this promotion is not capable of running as planned, including by reason of tampering, unauthorised intervention, fraud or any cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this competition, The Promoter may in their sole discretion cancel, terminate, modify or suspend the promotion, or invalidate any affected entries, subject to the approval of the relevant gaming authorities where required.
  3. If for any reason this competition is not capable of running as planned, including (without limitation) due to infection by computer virus, bugs, tampering, unauthorised intervention, fraud, technical failures or any causes beyond the control of the Promoter, the Promoter reserves the right in its sole discretion take any action that may be available, and (without limitation) to cancel, terminate, modify or suspend the competition, subject to any direction given under State Regulation.
  4. The Promoter does not exclude any rights and remedies in respect of goods or services under the Australian Consumer Law in the Competition and Consumer Act (2010) (Australian Consumer Law) which cannot be excluded, restricted or modified. However, the remainder of this clause will apply to the fullest extent permitted by law and the Promoter shall not be liable for any loss or damage whatsoever which is suffered (including, but not limited to direct, indirect, special or consequential loss or damage, loss of opportunity, revenue or profit) or for any personal injury suffered or sustained in connection with any prize/s except for any liability which cannot be excluded by law.
  5. The Promoter may communicate or advertise this competition using Facebook. The competition however, is in no way sponsored, endorsed or administered by, or associated with, Facebook. Entrants are providing their information to the Promoter and not to Facebook. Each entrant completely releases Facebook from any and all liability. Entrants acknowledge that all content posted on Facebook must be in accordance with Facebook terms (http://www.facebook.com/terms.php).
  6. All entries become the property of The Promoter. All opt-in entries will be entered into a database and The Promoter may use the entrant’s names, addresses and telephone numbers for future promotional, marketing and publicity purposes in any media worldwide without notice and without any fee being paid unless otherwise advised by the entrant. By opting-in, entrants confirm that they allow their details to be used for this purpose. If entrants no longer consent to their details being used for future marketing purposes, the entrant should contact The Promoter on their details set out below. Any request to update, modify or delete the entrant’s details should be directed to The Promoter.
  7. The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including but not limited to agents, contractors, prize suppliers and, as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period, unless otherwise advised, use the information for promotional, marketing, publicity, research and profiling purposes, including sending electronic messages or telephoning the entrant. The Promoter’s Privacy Policy contains information about how you can access and request the correction of your personal information. The Promoter’s Privacy Policy also contains information about how you can make a complaint about a breach of the Australian Privacy Principals and how the Promoter will deal with your complaint.
